Simon Marin Interviewed by CIPER Chile in Connection with the Wrongful Denial of Chilean Nationality to Children Born in Chile to Foreign Parents

Simón Marín was recently interviewed by CIPER Chile in connection with several cases involving children born in Chile to foreign parents whose Chilean nationality has been questioned or revoked by the Civil Registry. The cases address the interpretation of the constitutional exception concerning children of “foreigners in transit,” as well as the recent actions taken by the National Migration Service and the Civil Registry.
As reported by CIPER, Simón Marín represents five of the families who have brought legal actions seeking to protect their children’s Chilean nationality. In one of these cases, the Court of Appeals of Valparaíso ruled in favor of the child, finding that the authorities had acted arbitrarily and raising concerns regarding the constitutionality of the Civil Registry’s Circular No. 014. The case has subsequently been brought before the Supreme Court.
